Once the initial offer is accepted by the Commissioner, a report of sale must be filed with the Clerk of Court pursuant to NC Gen. Stat. §1-339.35. That initial offer to purchase is subject to upset bid or bids that must be filed with the Clerk of Court pursuant to NC Gen. Stat. §1-339.36.
